What the Evaluation Must Address

The evaluation does not explain its methodology. USCIS officers need to see how the conclusion was reached, not just what it is. An evaluation that lacks analytical support is easy to challenge.

 

The degree is three years and the evaluation does not address that. Three-year degrees from India, the United Kingdom, and several other countries do not automatically equal a U.S. four-year degree. If the evaluation does not acknowledge this and explain how equivalency is established, USCIS will likely ask for more.

 

The field of the degree does not connect to the specialty occupation. For H-1B purposes, the degree must be in a field directly related to the offered position. The evaluation should address this connection, not leave it for the officer to assume.

 

The employer letters for work experience are vague. When work experience is being used to supplement education, the employer letters must be specific about duties, responsibilities, and the progressive nature of the work. Generic letters are consistently challenged.
