A Dubai court has acquitted a company manager accused of embezzling approximately Dh6.23 million after finding that the evidence did not establish either misappropriation of company funds or the required criminal intent.
The dispute arose after two company partners accused the manager, who was responsible for management and financial matters, of improperly taking funds through withdrawals and other transactions between 2018 and 2024. They also pursued temporary civil compensation of Dh51,000.
During the proceedings, the court appointed an accounting expert to examine the company's financial records and supporting documents. The review found that the disputed transactions had been recorded in the company's accounts. Profit distributions were also supported by decisions signed by the complainants or their authorised representatives.
These findings were significant because they indicated awareness and approval of the transactions.
The court explained that establishing a breach-of-trust offence requires more than evidence of financial disagreements or debit balances between business partners. There must also be sufficient proof that entrusted funds were intentionally misappropriated or used unlawfully.
The evidence presented did not establish those elements. The manager was therefore acquitted, while the related civil claim was rejected. The complainants were also ordered to bear the applicable costs and legal fees.
