Important things to be noted:
- Small Business Relief is not automatic. The company must actively elect it on EmaraTax for each qualifying period.
- Electing suspends the tax losses and net interest deductions for that year.
- A free zone entity that elects it cannot simultaneously claim Qualifying Free Zone Person (QFZP) status.
- If the tax period is ending on 31 December 2026, the company must extend the relief as it would be their last full qualifying year.
Free Zone company owners often misunderstand that all free zone entities are automatically tax-exempt. To get the 0% rate on qualifying income, they must pass an annual substance and activity test, keep non-qualifying income within a strict de minimis limit, and prepare audited financial statements under IFRS.
Businesses that lose QFZP status in any period will be disqualified from the start of that period and the following four tax periods. This sums up to five years of paying the full 9% rate with no Small Business Relief fallback.
