A PAN (Permanent Account Number) Card is a unique 10-digit alphanumeric identifier issued by the Income Tax Department. The main purpose of a PAN card is to function as an ID proof. Each person must possess only one PAN number since it is illegal to have more than one. If you are caught possessing duplicates, then the Income Tax Department is authorised to take legal actions or put financial penalty.

Reasons for having Duplicate PAN Cards

There are a few reasons for a person to possess multiple PAN cards. These are listed below:

  • When having any incorrect details in the PAN card, people often choose to apply for a new one instead of applying for an update in the current PAN card.
  • Usually, when a person does not receive their PAN card in a given period of time, they quickly opt for a reapplication, and they unintentionally end up having multiple PAN cards.
  • Most women opt for a reapplication in the case of their new surname after their marriage. They should instead get their last name changed by updating the surname on their existing PAN card.
  • Some people knowingly apply for duplicate PAN cards to evade taxes or fool the government. Such actions are deemed illegal and are a punishable offence, leading to strict penalties. 
  • Possessing an inoperative PAN card if you have stopped being an Indian citizen.

Penalty for having a duplicate PAN Card

An Assessing Officer is entitled to impose a heavy fine of Rs. 10,000 on the individual possessing duplicate or multiple PANs. It is also considered a violation of rules if you are using your duplicate PAN cards for multiple transactions, and the Income Tax Department is entitled to impose penalties on you. 

Finding multiple or duplicate PAN cards will immediately raise suspicions with the Income Tax Department. The reasons being:

  • A taxpayer may try to keep their total income below the highest tax rate by splitting their income, investments, and capital gains across two different PANs in order to avoid paying taxes.
  • Utilising several PANs to conceal transactions like buying and selling property or stocks, to evade examination on long-term capital gains.
  • A duplicate PAN card can hinder the ITD's ability to construct a thorough profile of the taxpayer's financial actions.

How to avoid a duplicate PAN Card Penalty

There are a few methods to avoid getting any penalties for having duplicate PAN cards. They are:

  • If your PAN card is damaged or lost for any reason, immediately report it to the Income Tax Department. 
  • Always check your PAN details if they are correct or not. In case of any mistakes, you can request an update from the Income Tax Department.
  • Surrender any additional PAN cards that you may have obtained unknowingly or by mistake. 
  • Keep yourself up to date with PAN rules to avoid any unintentional violations.

How to surrender a duplicate PAN Card

In case you have additional PAN cards, you must surrender them to avoid being charged with legal actions. You can surrender a duplicate PAN card in both online and offline modes. 

Online Mode

Given below are the steps to surrender any duplicate PAN cards.

  1. Access the official NSDL website and fill out the required form there. 
  2. Enter the details under “Changes or Correction in Existing PAN Data/Reprint of PAN Card”.
  3. You can tick the checkbox in the left margin of the PAN Card correction form to submit any additional PAN cards you have in possession. 
  4. Fill in the relevant details and pay the applicable fees.
  5. Submit the form, and you will get an acknowledgement number after successful payment.

Offline Mode

Follow the steps given below:

  1. Go to the nearest NSDL or UTIITSL PAN Facilitation Centre.
  2. Fill up Form 49A for Change/Correction in PAN with the necessary details. 
  3. Submit the form and get your acknowledgement slip for future references.

 

Another way in which you can surrender your duplicate PAN card is by drafting a letter to the Assessing Officer of your jurisdiction. The letter should contain your correct and valid details. Here are the various details you must provide in the PAN card surrender letter:

  1. Name: Your correct name must be provided in the letter. Ensure that the name matches the one on your official PAN card.
  2. Address: Your correct and valid residential address must be mentioned in the letter.
  3. Information regarding the PAN Cards: Your letter must have the clear and correct details of the PAN card you possess and the one you want to surrender.
