The Form EB-4 is a visa application form used by immigrants who wish to live and work in the United States permanently. This category is reserved for "special immigrants," which includes religious workers, former U.S. government employees, and certain other individuals. If you are in need of an EB-4 visa, then it is better to consult with an Italian immigration attorney to help you out with the entire process.

Eligibility Criteria:

To be eligible for an EB-4 visa, applicants must first obtain an immigrant petition from a prospective employer or another qualifying entity. This can be done with the help of an expert Italian immigration attorney. Once the petition is approved, applicants can then submit their Form I-485 (Application to Register Permanent Residence or Adjust Status) to USCIS. If everything goes smoothly, they will eventually receive their green card and be allowed to live and work in the United States indefinitely.

There are a few different ways to qualify for an EB-4 visa. The most common is through employment, but individuals can also qualify based on their relationship to a qualifying employer, such as being a dependent child or spouse. There are also a few other categories of special immigrants, which are listed below.

Religious Workers:

The religious worker category is reserved for individuals who have been employed full-time by a religious organization in the United States for at least two years immediately preceding the filing of their Form I-485. To qualify, applicants must be entering the country to work in a religious vocation or occupation and must be a member of the same religious denomination as the organization they will be working for.

Former Employees of the U.S. Government:

This category is reserved for individuals who have been employed by the U.S. government in certain capacities, such as embassy staff or employees of international organizations. To qualify, applicants must have been employed for at least three years immediately preceding their application and must be able to demonstrate that they are seeking employment in the United States in a similar capacity.

Special Immigrants Juveniles:

The Special Immigrant Juvenile (SIJ) category is reserved for foreign children who have been declared dependent on a state court and cannot be reunited with their parents because of abuse, abandonment, or neglect. To qualify, applicants must be under the age of 21 and must not have a spouse or child who is also eligible for SIJ status. Once granted, SIJ status will allow children to live and work in the United States permanently.

Other Categories of Special Immigrants:

There are a few other categories of special immigrants, which are listed below. To qualify for one of these visas, applicants must meet all of the eligibility requirements outlined by USCIS.

-EB-4 Visas for Certain Employees of the U.S. Government Abroad

-EB-4 Visas for Certain International Organization Employees or Family Members

-EB-4 Visas for Afghanistan and Iraq Translators/Interpreters

-EB-4 Visas for Afghan and Iraqi Nationals Who Have Provided Faithful Service to the U.S. Government

Can immigration attorneys help in filing an EB-4 visa?

It can be extremely helpful to have an Italian immigration attorney assist with the filing of an EB-4 visa. The expert attorneys at Di Martino Law Group can help ensure that all of the necessary documentation is collected and that the petition is filed correctly. In addition, if there are any complications during the process, an attorney will be able to provide guidance and represent the applicant in court, if necessary.
