When we talk about a labour agreement for a visa in Australia, it relates to a work visa. Australia offers a range of work visas to fulfill the shortage of workers in specific fields like dairy, agriculture, restaurant, horticulture, etc. Every year, the country releases a list of job profiles facing the manpower shortage for which companies in Australia want to hire overseas workers. These work visas can be temporary or permanent.

What is a labor agreement?

An agreement develops between the Australian government and employers in the country that is in effect for five years. According to the agreement, employers can show their need to hire overseas skilled workers because of the shortage of employees and cannot be fulfilled within the country. As the tenure of 5 years over, employers can reapply for a labor agreement. There are five types of work agreements and each one has unique requirements.

Types of Visas Need a Labour Agreement to Be Signed

Temporary Skill Shortage Visas

Subclass 482 is a provisional visa for Australia. Overseas skilled workers are hired for a specific tenure and are eligible to apply for PR. Therefore, it is one of the most famous work visas. It falls into several streams like short-term, medium-term, labor agreement, and subsequent entrant. The labor agreement stream is valid for up to 4 years for applicants from most countries. Employers who have a labor agreement can sign the agreement.

Employer Nomination Scheme Visas

The Subclass 186 visa allows nominated workers to live and work in Australia permanently. The PR visa has three streams- Direct Entry, Labour Agreement, and Temporary Residence Transition. The labor agreement stream requires employers to sign the agreement. The processing period can be as quick as 47 days or may take up to 8 months for approval.

Skilled Employer Sponsored Regional Visa

The visa is offered to regional employers facing a labor shortage in their region. It is a provisional visa plan like TSS where overseas employees can apply for PR. The visa has three primary streams – Employer Sponsored Stream, Labour Agreement Stream, and Subsequent Entrant. The Labour Agreement Stream is valid for up to 5 years where overseas employees can work for the nominated employers. The processing time of the visa is not mentioned.
