In Trump v. Anderson, the Supreme Court held unanimously that states cannot use Section 3 of the Fourteenth Amendment to disqualify someone from federal office (including the presidency). The case arose when the Colorado Supreme Court had tried to remove Trump from the ballot, claiming his involvement in the January 6 attack amounted to an “insurrection.”
