As the number of giving Divorce to Foreign Spouse in Singapore has increased, it is necessary to better assess the degree of complexity in these situations. Given that it contains issues that transcend international borders, an international divorce is a complicated and emotionally charged process.

Legal requirements

You are also permitted to start divorce proceedings in Singapore if you are married to a foreign spouse. In general, the court has the authority to hear the divorce if one party is a Singaporean.

If you are both foreigners, you must have lived in Singapore as a habitual resident for at least three years before you can file for divorce.

Three years of marriage are also required for both parties. However, you must prove that you have endured unusual hardship in the marriage or that your spouse has acted with remarkable wickedness toward you if you want to petition for divorce before three years of marriage.

On the basis that your marriage is null and void, you can also choose to have it annulled, however this is different from getting a divorce. When you want to end your marriage, you must submit an application for a nullity of marriage, which claims that there was never a legal union to begin with.

The process must be started within three years of your marriage, and both parties must be residents of Singapore.

Reasons for divorcing

You must demonstrate that your marriage has irretrievably broken down on one of four grounds—adultery, unreasonable behaviour, desertion, or separation—just like in any divorce in Singapore.

You are unable to coexist with your spouse since they have committed adultery.

Because of your spouse's unreasonable actions, it is no longer reasonable to expect you to live with them.

For a minimum of two years, your partner has been unfaithful to you.

You have lived apart from your spouse for a continuous four years, or you have lived apart from your spouse for a continuous three years and both parties agree to divorce (no consent of the other party is required for divorce).
