SECURITY DEPOSIT

The security deposit is generally reimbursed when the tenant vacates the ensuite room. However, if the tenant vacates without clearing utility bills or causes damages, then the landlord is legally entitled to retain the deposit amount.

BASIC AMENITIES

In Singapore, it remains the landlord’s responsibility to make sure that the ensuite room provides basic amenities like regular quality water supply and electricity.

In the event of the landlord disconnecting the supply suddenly for some reasons other than non-payment of bills, you as a tenant will have the right to file a police complaint or approach the court. 

ENSUITE ROOM MAINTENANCE

Generally, maintenance charges of the ensuite room are factored into the rent or paid separately by the tenant.

In Singapore, when it comes to normal wear and tear and other such related issues, the landlord is responsible for bearing the cost of maintenance and other related charges. However, there are some landlords who put the onus of responsibility for such incidents on tenants.

Repairs must be carried out only with the mutual consent of both tenant and landlord; and the landlord should bear the responsibility of cost of repairs and other related charges.

TENANT EVICTION 

In Singapore, a landlord can ask the tenant to vacate the premises if he/she has violated the rent agreement or other guidelines. Such instances could include misuse or change in the nature of the usage of the premises; non-payment of rent and other charges / extreme late payment of rent arrears and other charges; sub-letting the premises to someone without landlord’s permission; landlord wanting to sell of the premises; and so on. 

However, the landlord must give prior eviction notice and cite the reasons for the same. The notice must be of 15 days or as mentioned in the rent agreement between the two parties.

NEW LANDLORD

There are instances wherein the landlord would want to sell off the premises. In such instances, the landlord is bound by law to inform you about the same well in advance before asking you to vacate the premises. 

If you as a tenant would still like to stay on in the same premises, then you can ask the new landlord about the same. If the new landlord agrees, then either the existing rent agreement will continue to hold with no need for a new agreement or a new rent agreement must be drafted. In either case, the landlord is law-bound to honor the terms of the rent agreement.

 The rent agreement between the landlord and tenant is the most important document. As such, it must be properly drafted and made watertight. As a tenant, you must ensure that the rent agreement contains all the requisite terms like the amount of rent and security deposit; maintenance charges and other charges, if any; duration of the rent agreement; termination and extension, if any, of the rent agreement; and landlord’s inspection rights. Also, ensure that the rent agreement is made on a stamp paper and duly registered with the local authority. All of these will safeguard your interests in case of a dispute with the landlord.
